2. These terms
These terms apply when a consumer purchases goods from ezgift.co.uk. Please read them before ordering and save or print a copy. By placing an order, you confirm that the information you provide is accurate and that you are at least 18 years old or have the permission of a parent or guardian.
Nothing in these terms excludes or restricts rights that consumer law gives you.
3. Products
We take reasonable care to describe and display products accurately. Screen settings and the nature of handmade or 3D-printed production can cause minor variations in colour, finish, texture and dimensions. Such normal variations are not defects where the product remains as described and fit for purpose.
Product-specific warnings and age recommendations form part of the description. Products identified as containing small parts are not suitable for children under three years. Customers are responsible for following supplied safety information and supervising children where appropriate.
4. Personalisation
You are responsible for checking names, numbers, spelling, colours, uploaded images and other personalisation before submitting an order. We will manufacture the product using the details accepted with the order.
You confirm that you have the right to use any text, image, logo or other material you submit and that it does not infringe another person’s rights or break the law. We may refuse or cancel content that is unlawful, abusive, discriminatory, obscene or reasonably suspected of infringing third-party rights. If we cancel for this reason before production, we will refund amounts paid for the affected product.
Personalised and made-to-order goods are subject to the cancellation exception explained in our Refunds, Returns and Cancellations Policy.
5. Prices and payment
Prices are shown in pounds sterling. EZ GIFT is not VAT registered. The total product price, available delivery methods and delivery charge are shown before the order is submitted. Paid delivery charges depend on the order and are calculated at checkout.
Payment is processed securely through the payment methods offered at checkout. We do not receive or store your complete payment-card details.
6. Orders and acceptance
The checkout process allows you to review and correct order information before submitting it. An order is an offer to purchase. Our order acknowledgement confirms receipt but does not by itself mean the order has been accepted. A contract is formed when we confirm acceptance or begin producing or dispatching the goods, whichever happens first.
We may reject or cancel an order if a product is unavailable, payment is not authorised, there is an obvious pricing or description error, delivery is unavailable to the address, personalisation breaches section 4, or we reasonably suspect fraud. If payment has been taken for a cancelled order, it will be refunded.
7. Promotions and free postage
Promotions are subject to their stated conditions and availability. Unless stated otherwise, only one promotion may be used per order. Free standard postage applies when the order value is £15 or more after discounts and promotions. We may withdraw or change a promotion prospectively, but not after an eligible order has been accepted.
8. Production and priority production
Estimated dispatch information is displayed on product pages or during ordering and may change with production capacity. Priority Production, where selected for an additional fee, moves the order into a priority queue. It is not a guarantee of same-day production, same-day dispatch or delivery by a particular date.
9. Delivery
We currently deliver only within the United Kingdom, normally using Royal Mail. Our Shipping Policy forms part of these terms. Risk passes to you when the goods are delivered to you or a person you nominate. Legal ownership passes when we receive payment in full.
10. Cancellations, returns and refunds
Our Refunds, Returns and Cancellations Policy explains your rights and the process to follow. Non-personalised goods normally carry a 14-day change-of-mind cancellation right. That right does not apply to goods made to your specifications or clearly personalised. Statutory remedies for faulty, damaged, misdescribed or incorrectly supplied goods continue to apply.
11. Our responsibility
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory rights.
We supply products for private and domestic use. If you use them for a commercial purpose, we are not responsible for business losses such as lost profit, lost revenue or loss of business opportunity, to the extent permitted by law.
12. Events outside our reasonable control
If production or delivery is affected by an event outside our reasonable control, we will contact you as soon as reasonably possible and take steps to minimise the effect. Your legal rights, including any right to cancel because of a significant delay, remain unaffected.
13. Privacy
Our Privacy Policy explains how we use personal information. Our Cookie Policy explains the technologies used on the website.
14. Complaints
Send complaints to orders@ezgift.co.uk or write to the address in section 1. Include your order number and the nature of the problem. We aim to acknowledge complaints promptly and resolve them fairly.
15. Changes to these terms
We may update these terms for future orders. The terms in force when an order is accepted will apply to that order unless a change is required by law or agreed with you.
16. Governing law
These terms are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom where you live, and you retain any mandatory protections that apply there.
